BAGYOURREWARDS.COM REWARDS PROGRAM TERMS AND CONDITIONS
The BagYourRewards Program rewards Participants with Reward Points based on the usage of reusable bags, the amount of money spent at participating retailers each time reusable bags are used and how frequently participants use reusable bags. Reward Points can then be used to redeem rewards through the BagYourRewards Program. BagYourRewards partners with retailers to offer the BagYourRewards program to consumers. Consumers can register at participating retail locations or online through BagYourReward's website. Consumers that register for the program can elect to receive a BagYourRewards card to scan at the point of sale or can use their existing loyalty card for participating retailers that offer a loyalty club program.
By registering for the BagYourRewards program each participant agrees to the following Terms and Conditions:
DEFINITIONS
- "Account" means a record kept by BagYourRewards of a Participant's balance of Reward Points and Reward redemption history. Each individual account will be identified by a specific Account number.
- "Participant" means the adult(s) of a household that have registered their household in the BagYourRewards program.
- "Reward Points" represent the value awarded to a Participant for a transaction at a participating retailer where they used reusable bags. These Reward Points can then be used by Participants to redeem Rewards through the Rewards Program.
- "Rewards" are gift certificates, coupons or some other item of value offered through the BagYourRewards Program to Participants in exchange for Reward Points.
- "Rewards Partners" are companies and individuals that offer Rewards through the BagYourRewards Program and agree to receive Reward Points in exchange for Rewards. Reward Partners may change without notice and any particular Rewards Partner is not guaranteed to be available at all times or in all geographic regions.
REWARD POINTS
- To collect points for a transaction where reuseable bags are used, your BagYourRewards card or your loyalty card for the participating store must be scanned at the point of sale.
- In order to use your retailer's loyalty card to accrue BagYourRewards Reward Points, participants must have linked their loyalty card to their BagYourRewards account. The easiest way for participants to do this is to log into their account through the BagYourRewards website and enter their valid loyalty card number and select the retailer from the drop down box provided.
- The BagYourRewards program is only for personal use and Reward Points cannot be transferred, sold or traded. Reward Points may only be pooled by members with the same postal address.
- Every $1 spent at participating retailers will be converted into 1 Reward Point every transaction where reusable bags are used.
- Participants have the ability to earn bonus Reward Points by using reusable bags in consecutive weekly trips at the same retailer. If a Participant shopping at store A used reusable bags on January 1, 2008, they could earn 1.5 Reward Points for every $1 spent on their next trip to Store A if they use reusable bags and as long as that trip occurs before January 8, 2008 (i.e. within one week of the first trip).
- BagYourRewards reserves the right to change the conversion rate of dollars spent to Reward Points at anytime.
- In order to continue to accrue Reward Points, participants must have registered with the BagYourRewards program, not have cancelled their registration with BagYourRewards, and must not be in violation of any the Terms and Conditions of the program.
- BagYourRewards Reward Points will expire after one year in which no account activity takes place (either earning additional Reward Points by shopping with reusable bags at participating retailers or using Reward Points to redeem rewards).
REDEMPTION OF REWARDS
- Participants may redeem Reward Points for Rewards by logging into their account through the BagYourRewards website.
- In order to log into their account online, a participant must have their BagYourRewards account number, valid email address and password.
- For purposes of the Rewards Program, any individual in a household who has the required account information to make a redemption will be authorized to redeem rewards on behalf of that account (Authorized Redeemer).
- Rewards are subject to limitations including the following:
- Availability - Rewards Partners may elect to limit the total number of a reward offered or put limitation on the number of a reward that are permitted per household. Some Reward Partners may also choose to limit their rewards to specific geograhic locations.
- Any specific terms and or conditions that are specified by the provider of the reward (expiration date, requirement to provide additional personal information, etc.)
- Rewards Partners will determine at their sole discretion how many Reward Points must be redeemed for each reward they offer.
- Rewards will either be printable online or will be sent by mail. If mailed, rewards will ship within three days of purchase whenever possible. BagYourRewards makes no promises about length of time for delivery.
- Each account will be limited to one free mail delivery for rewards a year, with each additional mailing costing $0.50.
- BagYourRewards has no obligation to replace lost, stolen or misplaced rewards.
- Once redeemed, rewards are non-refundable and cannot be traded in for other rewards.
- If a Rewards Partner refuses to honor a reward that has been redeemed by a participant, then BagYourRewards' only obligation will be to credit that participants account for the level of Reward Points used to redeem that particular reward. If there is no record from BagYourRewards that the reward was acquired legitimately through the Rewards Program (i.e. reward is counterfeit), then BagYourRewards will have no obligation to the participant and the participant will be removed from the program.
- If delivery of a reward fails as a result of error on behalf of the participant (i.e. incorrect address provided), then the participant may be subject to charges related to any re-send shipments.
MISCELANEOUS TERMS
- The collection, use, storing, sharing and protection of personal information is subject to the Privacy Policy that is contained on the website.
- BagYourRewards is responsible for tracking participants Reward Points based on transaction data provided by participating retailers. It is the responsibility of each Participant to ensure that they use their loyalty or BagYourRewards card at the point of sale in order to get credit for their shopping with reusable bags. BagYourRewards will not provide Reward Points for transactions that were not recorded by the participating retailer as one in which reusable bags were used.
- BagYourRewards reserves the right to audit any BagYourRewards account and to change the Reward Points balance without notification if the audit shows any inaccuracies. If a participant believes there have been inaccuracies in the calculation of their Reward Points, the participant must notify BagYourRewards promptly (but in no event later than thirty (30) days after the error occurred). If a participant does not notify BagYourRewards within the timeframe above, BagYourRewards' calculation of Reward Points will be deemed to be accurate and the participant will no longer have the right to request an adjustment.
- Participants are responsible for any taxes, fees or other charges that arise from participating in the BagYourRewards Rewards Program.
- BagYourRewards maintains the right to modify these Terms and Conditions, the Rewards Program, the rules, rewards, and any special offers at any time, without notice. This includes, but is not limited to, BagYourRewards' ability to (i) change the amount Reward Points earned for using reusable bags; (ii) change the name of the currency to something other than Reward Points and may also determine the value of the new currency; (iii) change the level of Reward Points required to redeem a reward; (iv) change the rewards being offered through the Rewards Program; or (v) cancel the program without notice. If the program is canceled, participants would have the right to use accumulated Reward Points within ninety (90) days after the cancellation to redeem rewards subject to the Term and Conditions.
- These Terms and Conditions are severable. If a particular term is determined to be invalid or unenforceable, that does not impact the enforceability or validity of the other terms included herein.
- By participating in the BagYourRewards program, every participant knowingly, voluntarily and intentionally waive any right they may have to a trial by jury in respect of any litigation based on, or arising out of, under or in connection with the BagYourRewards program and these Terms of Conditions.
- These Terms and Conditions are solely intended to be for Participants in the program and are not intended to benefit any other person or third party.
DISCLAIMER AND LIMIT OF LIABILITY
- BagYourRewards makes no representation or warranty for any products or services obtained through the program from any Rewards Partner.
- BagYourRewards makes no representation or warranty as to the results any individual Participant may obtain through their participation in the BagYourRewards program.
- BagYourRewards does not assume any responsibility or liability for injury caused by the actions, products, or services received from any Rewards Partner, and will not be liable or responsible for the performances, guarantees, warranties and representations, if any, provided by any third party related to these actions, products or services.
- If BagYourRewards is held liable for any damages under the Rewards Program, the Participant's sole and exclusive remedy will be limited to providing appropriate credit in Rewards Points to a Participant's Account.
